문화체육관광부(장관 유인촌, 이하 문체부)는 저작권 등록 시 창작자의 비용 부담을 덜고 업무상저작물 참여자도 저작권등록부에 성명 등을 기재하도록 개정한 ｢저작권법｣ 시행규칙(제6조, 제23조 등)이 5월 7일부터 시행된다고 밝혔다.

웹툰·웹소설 등 순차적저작물의 저작권 등록 수수료 낮춰

웹툰, 웹소설과 같이 일부분씩 순차적으로 공표하여 완성하는 저작물은 최초 저작권 등록 후 두 번째 등록부터는 수수료를 인하(2~3만 원 → 1만 원)한다. 이에 따라 50회 완결인 웹툰을 온라인으로 매회 등록하는 경우 창작자의 비용 부담이 종전 118만 원에서 69만 원*으로 41.5% 줄어들게 된다.

※ 50회 완결인 ‘가’ 웹툰 저작권 등록 시 납부 비용(온라인 등록의 경우)

(기존) {수수료(20,000원/건) + 지방세(3,600원/건)} × 50회 = 1,180,000원

(개선) {수수료(20,000원/건) + 지방세(3,600원/건)} + {수수료(10,000원/건)+지방세(3,600원/건)}

     × 49회 = 690,000원

특히 매회 저작권을 등록할 때 발생하는 비용이 부담스러워 웹툰, 웹소설이 마지막 회로 완결될 때까지 저작권 등록을 미루는 저작자들도 있었으나, 이제는 이들도 큰 부담 없이 연재 첫 회 시작과 함께 저작권을 등록해 저작권 침해에 더욱 적시에 대비할 수 있을 것으로 보인다.

장애인, 국가유공자 등에게도 저작권 등록 수수료 면제

또한 저작권 등록 수수료 면제 대상도 확대한다. 기존에는 「국민기초생활 보장법」에 따른 생계급여 또는 의료급여 수급자에 한해 저작권 등록 수수료를 면제했으나, 앞으로는 장애인, 국가유공자 및 5·18민주유공자 등의 저작권 등록 수수료도 면제한다. 다만, 등록 수수료 면제 횟수는 연간 10회까지이다.

업무상저작물 작성에 참여한 사람도 저작권등록부에 기재, 창작 의욕 높여

법인･단체 등의 기획 아래 해당 기관의 업무에 종사하는 자가 작성하는 업무상저작물은 계약 등에서 따로 정하지 않으면 법인 등이 저작자가 되고, 법인명 외에 해당 창작활동에 참여한 개인의 성명은 저작권을 등록할 때 기재되지 않았다.

이에 법인·단체 등에 속한 참가자의 창작 의욕을 높이기 위해 지난 2월 6일, 업무상저작물의 작성에 참여한 사람의 성명과 생년월일을 저작권등록부에 기재할 수 있도록 하는 내용의 ｢저작권법 시행령｣ 개정이 공포됐다. 이번 시행규칙 개정은 그에 따른 후속 조치로 저작권등록신청명세서와 프로그램등록신청명세서 서식에 업무상저작물의 작성에 참여한 사람의 성명과 생년월일 기재란을 신설했다. 이로써 업무상저작물 창작활동에 참여한 사람들의 참여 사실을 명확히 할 수 있게 되었으며, 이들은 필요한 경우 저작권등록부를 경력 확인 등에 활용할 수 있다.

문체부 정향미 저작권국장은 “저작권 등록은 저작권 분쟁 발생 시 상대방에 대해 대항력을 갖게 하는 등 거래의 안전을 위한 매우 중요한 장치”라며, “저작권 등록 수수료 인하와 면제 대상 확대 등 이번 제도 개선은 저작권 등록 활성화를 유도해 창작자들의 권익을 강화하고 나아가 웹툰, 웹소설 등 새롭게 창작되는 콘텐츠의 저작권 보호에도 기여할 것으로 기대한다.”라고 밝혔다.

The Ministry of Culture, Sports and Tourism announced that the Enforcement Rules of the Copyright Act, which have been revised to reduce the cost burden on creators when registering copyrights and to allow participants in work for hire to enter their names in the copyright register, will take effect on July 7.

According to the revised enforcement rules, works that are completed by publishing parts sequentially, such as webtoons and web novels, will have their fees reduced from the previous 20,000 to 30,000 won to 10,000 won from the second registration after the first copyright registration. As a result, if a webtoon that has been completed 50 times is registered online each time, the cost burden for creators will be reduced by 41.5 percent, from 1.18 million won to 690,000 won.

The Ministry of Culture, Sports, and Tourism said, "Some authors delayed copyright registration until the last installment of their webtoon or web novel due to the high cost, but now they can register their copyrights at the start of the first installment without much burden and prepare for copyright infringement in a more timely manner."

The copyright registration fee exemption will also be expanded. Previously, only recipients of livelihood or medical benefits under the Basic Livelihood Security Act were exempted from copyright registration fees, but from now on, copyright registration fees will also be exempted for people with disabilities, national meritors, and 5-18 democracy heroes. However, the number of registration fee exemptions is limited to 10 per year.

Participants in the creation of business works will also be listed in the copyright register. On February 6, an amendment to the Enforcement Decree of the Copyright Act was promulgated to allow the name and date of birth of the person who participated in the creation of the work to be recorded in the copyright register in order to increase the creative motivation of participants belonging to corporations and organizations.

The amendment to the Enforcement Rules is a follow-up to the amendment to the Copyright Act, which requires that the name and date of birth of the person who participated in the creation of the work be entered in the form of the copyright registration application and program registration application.

"This will make it possible to clarify the participation of those involved in the creation of creative works for business," the ministry said, adding, "They can use the Copyright Register for career verification if necessary."
